SB 493

✅Relating to protection of certain disclosures and communications by pharmacists and pharmacies regarding prescription drug benefits

✅ SB 493: Lets Pharmacists Tell the Truth About Drug Prices

What it says it does:
SB 493 protects pharmacists from being penalized for telling patients if their prescription would cost less by paying cash instead of using insurance.

What it actually changes:
It voids any contract that prevents a pharmacist from sharing cheaper price options. It also allows pharmacists to communicate directly with health plan sponsors about costs and reimbursements. These protections apply to new or renewed contracts starting September 1, 2025.

Who is pushing for it:
Texas Pharmacy Association, AARP Texas, patient advocacy groups, and major pharmacy chains supported the bill.

Who benefits:
Patients who can finally compare prices honestly. Pharmacists who no longer risk contract penalties for helping patients save money.

Who gets left out or exposed:
Pharmacy benefit managers and insurers lose control over restrictive contract terms. Patients covered under older PBM contracts signed before September 2025 will still be subject to those limits until they expire.

Why this matters long term:
It restores transparency in how prescription prices are set and gives Texans a fair chance to avoid overpaying. It begins to unravel the secrecy that has kept drug pricing inflated for years.

What to watch next:
PBMs may create new contract language to maintain control over pricing or restrict communication in other ways. Lawmakers may need to revisit enforcement to ensure the bill’s protections actually hold up.

Bottom line:
SB 493 is a win for patients and pharmacists. It promotes honesty at the counter and transparency in the system, showing that not every healthcare bill has to favor the middlemen.
