🟡 SB 2221: Fast-track fix for fraudulent lien filings

What it says it does:
Creates a process for Texans to clear fraudulent or harassing UCC financing statements with a sworn affidavit and gives courts a fast-track to review challenges.

What it actually changes:
Adds a 30 day termination clock once an affidavit is accepted, allows the Secretary of State to reject affidavits missing strict notice requirements, gives the agency immunity and fee authority, and creates a carve-out so banks and regulated lenders can reinstate filings immediately by notice.

Who benefits:
Banks, mortgage lenders, auto-finance companies, and large manufacturers who get quick reinstatement of their filings and protection against fraudulent lien challenges. The Secretary of State gains fee revenue and immunity for acting under this law.

Who gets left out or exposed:
Individual Texans and small businesses trying to clear false filings face strict technical hurdles and must travel to a single court venue. Their affidavits do not apply if the filer is a regulated lender.

Why this matters long term:
