SB 2798

🟡Relating to certain statutes of limitations for criminal offenses, including the statute of limitations for certain fraud offenses.

🟡 SB 2798: Extends prosecution window for fraud crimes

What it says it does:
It gives prosecutors more time to file criminal charges in fraud cases. The official reason is to help law enforcement pursue complex financial crimes that can take years to uncover.

What it actually changes:
Most fraud crimes under Chapter 32 of the Penal Code now have a seven-year statute of limitations instead of five. Forgery remains at ten years. The bill does not reopen old, expired cases and takes effect September 1, 2025.

Who is pushing for it:
Sen. Brandon Creighton sponsored the bill. Support in the files came from district attorneys, police associations, and the Texas Mortgage Bankers Association. No opponents are listed.

Who benefits:
Prosecutors and law enforcement gain more leverage and time to investigate. Banks and lenders get stronger chances to recover losses or restitution in fraud cases that surface late.

Who gets left out or exposed:
Defendants lose an important protection against stale prosecutions. Local courts and public defenders could face more long-term workload without extra funding or oversight requirements.

Why this matters long term:
Extending limitations sounds procedural, but it shifts power toward the state and large financial institutions. Over time it can normalize longer criminal timelines without adding fairness or transparency standards.

What to watch next:
Future sessions may push to expand these longer timelines to other financial or digital crimes. Lawmakers may also seek new subpoena or data-sharing powers tied to these investigations.

Bottom line:
SB 2798 strengthens fraud enforcement but weakens a key due-process safeguard. The state gains time and leverage, while everyday Texans gain little protection from slow or delayed prosecutions.
